Meeting Minutes 6-1-21

June 1, 2021

Leroy Township Hall, 1685 N. M-52, Webberville, MI.

Meeting called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Board members present: Earl L. Griffes, Wilma J. Whitehead, Heidi Ream, Loretta K. Benjamin, R. Scott Diederich.

Also present: Amanda Vorce, Larry Fulger, Dennis Dyko, Apex Clean Energy Representative, Shelly Schaub.

The minutes of the May 4, 2021, regular meeting were presented. After review, Benjamin moved to accept the minutes, with a correction of a first name, in paragraph four. Support, Ream. The motion passed.

Larry Fulger was present and stated that he has obtained his electrical permit and an estimate to dig a new well and plans to have it started, as soon as their tiny house sells. He is currently working on the home barriers.

Amanda Vorce, new head librarian, of the CADL Webberville Branch, presented their 2020 annual report. They have been working to provide hotspots for distance learning the Story Walk installation, in the Simmons Memorial Park, has been a big highlight and well received by area residents, with hopes to expand for a longer walk.

The Board discussed the plans for Todd & Loretta Benjamin to apply to the Michigan Liquor Commission, for a license to sell beer and wine, at their farm. The use might fall under the Right to Farm Act or under the Agritourism Farm Plan. Griffes will check with the Township Attorney and Planner before a resolution is considered.

N.I.E.S.A. report given by Earl Griffes, who attended the May 13^th meeting. The N.I.E.S.A. Board accepted the Standard Operating Guideline (SOG) for Rehab. Also, discussed Website, Billing Ordinance, New Auditor, Federal Funding for State/Local Coronavirus Rescue Funds and Reinvestment of a six month CD.

After review, Whitehead moved to pay all bills as presented and the remainder of the regular monthly bills that are received during the next week. Support, Benjamin. Diederich-Yes, Ream-Yes, Griffes-Yes, Benjamin-Yes, Whitehead-Yes. The motion passed.

Meeting called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

After review, Diederich moved to accept the minutes of the April 6, 2021 regular monthly meeting, as presented. Support, Benjamin. The motion passed.

Mr. & Mrs. Fulger were present to updated the Board on their progress, to make their mobile home ready, to meet all the Township building requirements. They are in the process of getting a quote for drilling a new well and are doing electrical rewiring. They are planning to be done by Fall. Unable to eliminate any items, on the completed list of requirements, at this time.

Rezoning of property owned by Steve Geyer, was reviewed. Benjamin questioned that the proposed use of the property might require a Special Use Permit. Ryan Hitchcock stated that they plan on outdoor sales and C-1 could fit better because nursery and landscaping are allowed. James Utz stated that C-1 Zoning allows only indoor sales. Motion by Diederich to accept the Planning Commission recommendation to approve the rezoning from RA (Residential Agricultural) to C-1 (Neighborhood Commercial). Support, Ream. Diederich-Yes, Ream-Yes, Griffes-Yes, Benjamin-Yes, Whitehead-Yes. The motion passed. A site plan review is required.

Michigan’s Uniform Video Service Local Franchise Agreement between WOW (WideOpenWest Mid-Michigan, LLC) and the Township, was reviewed. Benjamin moved to accept the renewal, with the current 3% franchise fee. Support, Ream. Ream-Yes, Griffes-Yes, Benjamin-Yes, Whitehead-Yes, Diederich-Yes. The motion passed.

Diederich gave a report on the April 8, 2021 N.I.E.S.A. meeting. A change in the have a fee schedule attached to the Billing Ordinance and Rehabilitation Guideline Policy, were discussed. Representative Slotkin’s meeting, with Director Yanz, concerning the SAFR Grant Funds update for emergency department equipment, was positive.

The bills were presented and monthly invoices from Foster, Swift, Collins & Smith, P.C. included bills that were from another jurisdiction. Griffes moved to pay all bills except for Foster, Swift and Collins & Smith, P.C. Support, Benjamin. Griffes-Yes, Benjamin-Yes, Diederich-Yes, Ream-Yes, Whitehead-Yes. The motion passed.

Meeting was called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Board Members present: Earl L. Griffes, Wilma J. Whitehead, Heidi Ream, Loretta K. Benjamin, R. Scott Diederich.

Also present: James Utz, Lindsay Utz, Shelly Hall, Brian O’Shea, Larry Fulger, Dennis Dyko,

Tim O’Brien, Steve Moreno, Monica Moreno.

After review, Benjamin moved to approve the minutes of the March 2, 2021 regular monthly Board meeting. Support, Diederich. The motion passed.

The minutes of the Annual Budget meeting, on March 24, 2021, were reviewed. Motion by Benjamin to accept the minutes as presented. Support, Ream. The motion passed.

Public comment: Monica Moreno commented on the letter from Rosa Jones, presented at last month’s meeting. Apex, Inc., should be providing information on the current status of their proposed wind turbine project, so as to be able to include the information for public record. Brian O’Shea, Apex representative agreed that all information needs to be get out to the community and a public information meeting would be a good idea later. They are still in the early process of obtaining land and conducting wind studies. Shelly Hall asked who is going to make Apex accountable and that some residents are aware of the project and some are not. Mr. O’Shea stated that it is difficult to do a project in a community that is against it from the beginning. Monica Moreno questioned the possibility of a moratorium of the project or have monthly updates from the applicants available. Tim O’Brien asked if the number of land owners, that they have spoken with and have accepted to lease their property, was available. Mr. O’Shea responded that he will check for next month’s meeting. Trustee, Benjamin asked if once the land owner signs on are the fully committed and stated that some property owners are being misled.

Larry Fulger was present to discuss the progress he is making on his mobile home. Supervisor, Griffes reminded Mr. Fulger that a letter was sent, from the Township’s legal firm, more than 30 days ago, with no substantial progress to date. Mr. Fulger said one half of the trailer is studded and installing insulation, cabinets and drywall, at this time. His mother is not taking kindly to him cleaning up the property, even though he would like to. Mr. Fulger stated that his occupancy date is sometime this fall and he was reminded that his unproductive proceedings is putting the Township in a poor position, while knowingly letting this go on and being aware of the situation. Next month the Board wants a list of what needs to completed yet and to show more progress. Another winter of living in the tiny home will not be tolerated and will have to go to court, if not new residence is not complete enough for occupancy.

The 2021-2022 Street Light Budget was presented by Treasurer, Ream. After discussion, Benjamin moved to adopt the budget. Support, Whitehead. The motion passed.

Lawn Maintenance proposals were presented for review. Lawn Crafters, Inc. provided three proposals, which included mowing the Township hall property and the park, and the landscaping for the hall. Emjay Total Lawn Care proposals that were reviewed were for mowing the park, cemetery and the Township hall. After discussion, Benjamin moved to accept the contract with Emjay for the mowing of the park, cemetery and hall properties, for 2021. Support, Ream. Motion by Benjamin to accept the bid from Lawn Crafters, Inc. for the landscaping for the Township Hall for the 2021 season. Support, Diederich. Motion by Griffes to add Travis Nack to the Planning Commission. Support, Benjamin. Motion passed.

A letter from Nolan Law, LLC, which states that they have been retained by a group of citizens, from Wheatfield and Leroy Townships, who are concerned about the dangers of improperly sited industrial wind turbines, was reviewed. The Board felt that Mr. Nolan contacting and communicating with the Township legal firm shouldn’t be paid for by the Township, until and when Apex, Inc. files a formal request for with the Township, to proceed with their proposed wind turbine project.

March 2, 2021

Meeting was called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Board Members present: Earl L. Griffes, Wilma J. Whitehead, Heidi Ream, Loretta K. Benjamin. Absent: R. Scott Diederich.

Also present: Dennis Dyko, James Utz, Sean Stocker, Nick Alexander, Steve Moreno, Monica Moreno.

After review, Ream moved to accept the minutes of the February meeting as presented.

Support, Benjamin. The motion passed.

The Fulger property was discussed. Supervisor, Griffes reported that there is no heat source in their mobile home and they have not moved in. An occupancy permit is needed before they reside in the home. A letter was mailed to them, from the Township Attorney and they hadn’t picked it up. Griffes will deliver the letter to them. The Board agreed to grant them an additional 30 days.

A request for a Hardship Mobile Home Permit was reviewed, for Thomas H. Canfield, 1394 N. Dietz Road, Webberville. Mr. Canfield has a medical condition, which requires him to have continuous care and his daughter will reside, in their original residence. Their property is 2.5 acres parcel, without enough road frontage, to build another home on the property. Motion by Benjamin to allow the Canfields to place a mobile home on their property, subject to all building requirements and permits and the hardship home must be removed when it is no longer needed, by Mr. Canfield. Support, Ream. Ream-Yes, Griffes-Yes, Benjamin-Yes, Whitehead-Yes. The motion passed.

A letter from resident, Rosa Jones, stating her opinion on the proposed Wind Turbine Project, was discussed. A copy of the letter was made for everyone present. James Utz commented, on the Township survey and how it will affect the project. Apex representaives reply was that the survey is not an educated survey, which it lacks actual knowledge about the turbines.

An email was received from a resident about the opening of the park during the winter months.

The park is actually closed during the winter because of the liability and the need to plow the snow. Motion by Benjamin to adjourn at 7:37 p.m. Support, Ream. The motion passed.

Meeting was called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Board Members present: Earl L. Griffes, Wilma J. Whitehead, Heidi Ream,

Loretta K. Benjamin, R. Scott Diederich.

Also present: Colin Kummerfeldt, Mark Benjamin, Steve Moreno, Monica Moreno,

Dennis Dyko, Lindsay Utz, James Utz, Wheatfield Twp. Rep., White Oak Township

Rep., Local TV Station and others.

Public comment: Steve Moreno provided a handout relating to wind turbines. The

Apex representative stated that if the project is turned down they will go elsewhere.

Monica Moreno reviewed their attorney’s letter, with facts pertaining to the use of

wind turbines. Local resident and farmer, Mark Benjamin stated that in the beginning

he was against the turbines, but after talking with residents up north, reading studies

and statements against them, it has all changed his mind. He also, feels that he

doesn’t want them on his farm, but believes that in the next decade they will be

needed for an additional energy source. White Oak Township representative stated

that their Township has a forty acre parcel zoned, for the turbines.

The Township Attorney sent a letter to the Fulgers, stating that a substantial progress

of correcting violations, of the Township Building Code, within the next thirty

days or the case will go to court.

The Annual Township Organizational Meeting has been scheduled for Wednesday,

March 24, 2021, at 10:00 a.m. After review, Ream moved to adopt Resolution #2021-

02, for the consideration of the Township Officers’ salaries. Support, Benjamin.

Diederich reported that Mr. Sigel & John Risch retired from the Fire Department. The

departments current light pack defibrillators need updating and replacement quotes

January 5, 2021

Meeting was called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Board Members present: Earl L. Griffes, Wilma J. Whitehead, Heidi Ream, Loretta K. Benjamin, R. Scott Diederich.

Also present: Kenneth Dimoff, Colin Kummerfeldt, Shelly Hall, Scott MacGuidwin, Rhonda Sherwin, Monica Moreno, Steve Moreno, Renee Heide, T.S. Auten, Lindsay Utz, James Utz.

After review, Ream moved to accept the minutes of the December meeting as presented. Support, Whitehead. The motion passed.

Public comment: Shelly Hall questioned the accuracy of the November 3, 2020 General Election results. The Clerk stated that from all correspondence from the State Bureau of Elections that the results were fair and accurate.

Township residents were present for updates on and the process, for the proposed wind turbines. James Utz questioned Colin Kummerfeldt, Apex Representative, where they are at in their environmental studies. Mr. Kummerfeldt replied that their first study has been completed and only Agricultural land is being considered, with 10,000 acres leased already. Supervisor, Griffes stated that the Township Zoning Ordinance calls for a maximum height of 400 feet and their projected height is 650 feet. The Township has received around 200 surveys back with approximately 2-1 against. Steve Moreno stated that studies show that people walk away from properties because of wind turbine placed near their homes. James Utz noted that the Township should keep track of all expenses, because Apex had originally agreed to reimburse the Township, for all fees.

The BS&A Financial Program/Cash Receipting was explained by Treasurer, Ream. After discussion, Whitehead moved to approve the purchase of this last portion of the Financial Program. Support, Benjamin. Griffes-Yes, Ream-Yes, Diederich-Yes, Benjamin-Yes, Whitehead-Yes. The motion passed.

Ingham County Board of Commissioners approved a resolution to appoint William E. Fowler as the County Designated, to oversee local assessors. After review, Diederich moved to accept Resolution #2021-01 to accept the Resolution from the County Board of Commissioners. Support, Benjamin. Diederich gave the N.I.E.S.A. report for December, which included that they are looking for a new website designer and the meeting schedule has been made out for 2021. Don Henley was appointed to the finance committee, replacing John Kane.

December 1, 2020

Meeting was called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Board Members present: Earl L. Griffes, Wilma J. Whitehead, Heidi Ream.

Members absent: Loretta K. Benjamin, R. Scott Diederich.

Also present: James Utz, Lindsay Utz, Dennis Dyko, Shelly Hall, Larry Fulger

and family.

After review, Griffes moved to accept the minutes of the November meeting

as presented. Support, Whitehead. The motion passed.

Public comment: Shelly Hall had questions about the Dominion Tabulator

System’s random updates, at midnight, before the November Election. The

Clerk tried to explain the accuracy and security of the voting machines.

Larry Fulger informed that their mobile home was going to be delivered and set up tomorrow. There are some repairs needed to be done, there is a furnace,

with plans on adding a wood burner.

Hall rental during the pandemic was discussed. Griffes stated that they are

adults and should be responsible. Whitehead felt that the health and safety

of the residents would be compromised, by allowing gatherings, at this time. Motion by Griffes to rent the hall as normal. Support, Ream. Whitehead-No, Ream-Yes, Griffes-Yes. Motion failed with two yes votes.

Office mask requirements for anyone entering the building, were discussed.

Ream felt that masks should be worn. It was decided that the current sign, stating that masks are highly recommended and that the Plexiglas dividers

that were used during the election, be placed, on the office counter.

After review, Ream moved to contract with Webster, Griffes, Inc., at the same

rate, for the 2020-2021 season. Support, Whitehead. Motion passed.

The Williamston Senior Center Millage Proposal Resolution was reviewed.

Motion by Griffes to adopt Resolution #2020-03. Support, Ream. Ream-Yes,

After review, Griffes moved to pay the bills as presented and all the standard bills

November 10, 2020

Meeting called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Board members present: Earl L. Griffes, Wilma J. Whitehead, Roberta M. Hamlin, R.

Scott Diederich, Loretta K. Benjamin.

Also present: Dennis Dyko, Colin Kummerfeldt, Shelly Hall, James Utz, Lindsay Utz.

After review, Diederich moved to accept the October minutes, as presented. Support,

Benjamin. The motion passed.

Public comment: Dennis Dyko stated that a bald eagle was spotted at the corner of

Grand River and Dietz Road and felt that it’s presence should be considered when

considering the addition and construction of new wind turbines.

Supervisor, Griffes felt that some proactive action should be taken, to notify the Township residents, of the proposed wind turbines, within the Township. James Utz added that around 70% are not in favor of the turbines, a public hearing isn’t necessary at this point and an informational meeting could be considered, by the Board. Lindsay Utz questioned if a response from the community is necessary and to find inquire if a meeting is needed at all. Griffes will work on a letter to send out with the December tax bills, it will also be available, on the Township website and in the local newspapers.

Updates on the Fulger property were given and discussed. Post holes are filled with concrete, pylons are done, the footings outside of the mobile home need to be completed before the home is delivered and set up. Because of missing deadlines and no substantial progress, by

the Fulgers, the Board decided that a letter will be sent out, appealing for more progress by a December 1^st deadline or the Township legal service will be contacted.

The Clerk requested, that because of the nonstop line of voters and exposure to the virus,

the election inspectors be considered, for Election Day hazard pay. After discussion, Diederich moved that an additional $100.00 be added to the election workers regular hourly wages. Support, Whitehead. Benjamin-Yes, Griffes-Yes, Hamlin-Yes, Diederich-Yes, Whitehead-Yes. The motion passed.

Diederich reported that the 2021 N.I.E.S.A. General & Equipment Budget has been passed,

With 7.5 mills Building & Equipment and 1.2 mills General. An Investment meeting will be

on November 12^th and will be voted on. The training room in the Webberville Station will be named in honor of long time dedicated fire fighter, Gregg Flynn.

It was decided by the Board, that DeLau Fire Services recommendation to add two additional fire extinguishers, to the Township Hall will not be necessary, at this time.

Meeting called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Also present: Dennis Dyko, James Utz, Lindsay Utz, Sean Stocker, Kris Lycos,

Colin Kummerfeldt, Brian O’Shea, Heidi Ream, Debbie Schultz, Shelly Hall.

After review, Diederich moved to accept the minutes, of the September regular

meeting as presented. Support, Benjamin. The motion passed.

The Township has two vacancies on the Board of Appeals and received a letter of

Interest from Lindsay Utz and Kris Lycos. After discussion, Griffes moved to appoint

Kris Lycos to the Board. Support, Benjamin. Motion passed. Motion by Hamlin to

appoint Lindsay Utz to the Board. Support, Benjamin. The motion passed.

Apex Clean Energy, Inc. representatives were present to introduce their renewable

Energy Company and their proposed wind turbine project. Brian O’Shea introduced

Sean Stocker, who gave an overview of their company and their planned development.

The steps that will be taken are community development, wind and land studies,

power purchase agreements, construction and energize, and produce energy. The

audience had questions and comments. James Utz suggested that the Township

contact the Township Planners and Attorney to draw up information for all

Township residents and to get an objective view from them. Loretta Benjamin feels the

project will have an adverse effect on rural farm land and residents. Scott Diederich

noted that the public needs to get involved first of all. Dennis Dyko stated that feasibility

studies need to be completed. Shelly Hall felt that the people need to considered first

and property values will decrease because of the wind turbines.

Sean Stocker responses were that the wind turbines will produce needed clean energy,

the owners of their leased property will benefit financially, will increase jobs and

spending during construction and additional tax benefits for the community.

This was the an informational meeting and Apex Clean Energy, Inc. needs to apply

for a public hearing with the Township Planning Commission.

Trustee, Scott Diederich reported that N.I.E.S.A. meetings are still being held virtually.

Discussed the proposed alarm response requirements and budget public hearing dates.

DeLau Fire Services suggested that the Township Hall is getting older, that fire

extinguishers be provided for the furnace and computer rooms. Diederich will

check further to see if there would be an advantage to have them installed.

Motion by Diederich to table until next month. Support, Benjamin. Motion passed.

Meeting Minutes 9-1-2020

September 1, 2020

The Leroy Township Board Meeting was called to order at 7:00 p.m. by the Supervisor,

Earl L. Griffes.

Board members present: Earl L. Griffes, Wilma J. Whitehead, Roberta M. Hamlin, R. Scott

Diederich, Loretta K. Benjamin.

Also present: James Utz, Larry Fulger, Jennifer Fulger, Dennis Dyko, Heidi Ream.

After review, Benjamin moved to accept the August meeting minutes as presented. Support,

Diederich. The motion passed.

Arthur Webster and Mark Kucharczyk have both resigned from the Board of Appeals. The Supervisor will send letters of interest, to the residents that are interested in be appointed.

Larry and Jennifer Fulger were present to update the Board, on their plans to place a mobile

home, on their property. Mr. Fulger stated that the permit is taking longer to finalize then

they had anticipated. They also have applied for a new property address off of Frost Road.

They are in the process of staking the site, updating their driveway, installing a wooden

Foundation, with piers and cement blocks. They thanked the Board for being very patient

with them through this whole process.

The 2019-2020 Audit was presented. Board members requested additional time to review

the audit before adoption.

August N.I.E.S.A. meeting was held virtual again because of the pandemic. Their final audit

was accepted. Frans Wilbrink was appointed as primary Member-at-Large, filling a two year

term and Ben Stiffler was appointed as alternate Member-at-Large, for a four year term.

The bills were presented by the Clerk. Motion by Hamlin to the pay the bills as presented and

the additional bills that will be coming in later, because of the meeting being, on the first.

Support, Diederich. Hamlin-Yes, Diederich-Yes, Griffes-Yes, Benjamin-Yes, Whitehead-Yes.

The motion passed.

Apex Clean Energy, Inc. would like to meet with the Board at next month’s meeting.

The Clerk will put them on the agenda.

Benjamin moved to adjourn at 7:46 p.m. Seconded, Hamlin. The motion passed.
