Meeting was called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Board Members present:  Earl L. Griffes, Wilma J. Whitehead, Heidi Ream, Loretta K. Benjamin, R. Scott Diederich.  Also present:  Dennis Dyko, Lindsay Utz, James Utz, Steve Moreno, Monica Moreno, Tom Smith, Todd Benjamin.

After review, Benjamin moved to accept the November meeting minutes as presented.  Support, Ream.  The motion passed.

Public Comment:  Supervisor, Griffes stated that the recommendations from the Planning Commission meeting, on November 17, 202l, will be taken up at the next meeting, of the Township Board, on January 4, 2022.

Diederich gave the N.I.E.S.A. report from their meeting, on November 11, 2021. Approved the 2022 meeting schedule and Resolution 6 of the Fiscal Year 2022 Building/Equipment Appropriation Act.  The plans for the update of the N.I.E.S.A. Leroy Township Station are in the works and the Williamston Station will be paid off in full in 2022.

Trustee, Loretta Benjamin gave a report, on the November 11, 2021, Planning Commission meeting, which dealt with the Zoning Ordinance Amendment Reviews.  Sections 202 Definitions, 430 Marijuana Care Givers, 305,406 Setbacks for Porches & Decks, 436 Marijuana Care Givers per Household, 1508 Violations and Penalties, were recommended for review and approval to the Township Board.  Section 1003, Project Design Standards/Agritourism definition was excluded from the motion.

The bills were presented and after review, Benjamin moved to pay all bills.

Leroy Township Board Meeting                                                                

Tuesday, November 2, 2021 – 7:00 p.m.

Leroy Township Hall, 1685 N M-52, Webberville, MI

Board members present:  Earl L. Griffes, Wilma J. Whitehead, Heidi Ream, Loretta K. Benjamin, R. Scott Diederich.  Also present:  Shelly Hall, Dennis Dyko, James Utz, Lindsay Utz, Steve Moreno, Monica Moreno.

After review, Diederich moved to accept the minutes as presented.  Support, Benjamin.  The motion passed.

The proposal to contract with AGS Mechanical & Electrical, was discussed.  It was stated that the company has a record of allowing inspections that are not up to current code regulations, which have caused problems, for commercial sites.  The Board decided to stay with the State, for the Township’s electrical and mechanical inspections, at this time.

One bid for snow plowing was received from Webster & Griffes, Inc.  After review, Diederich moved to accept the bid, for the 2021-2022 season.  Support, Ream.  The motion passed.

A report was given by Benjamin, on the last Planning Commission meeting, September 8, 2021, which was a site plan review, for Geyer property on Grand River, which passed unanimously. A report was given by Whitehead, on the last Board of Appeals meeting, September 14, 2021, which was held for Mark and Mary Hitchcock’s variance request, addressing the lot width for their parcel, that is 66 feet wide.  Section 1210 of the Township zoning ordinance was cited stating that a variance wasn’t needed because the easement was established prior to 2018 and is grandfathered in.

Diederich gave a report on the October 14, 2021, N.I.E.S.A. meeting.  The training room at the Leroy Station was dedicated, as the Greg M. Flynn Training Room, recognizing his twenty year service with the department.  A revision to the Departments Retirement Plan was made with a match Increase of 5% to 10%.  A feasibility study for the renovation, of the NIESA Leroy station is being discussed and the Village of Webberville is planning on paying their share of the needed siren repairs and updates.

Supervisor Griffes, presented a letter, dated September 27, 2021, from the Township Attorney.  The letter stated procedures, for the Township to consider, for Planned Unit Development, Agri-Tourism Ordinance plans and site plans reviews, by the Planning Commission and Township Board.

Currently there are no Planned Unit Developments, in the Township.  Comment was that the Township Board should have to approve all PUD’s and the Township needs to be careful what precedencies are set.  Benjamin stated there is more control with a PUD development. Shelly Hall felt that after the Planning Commission recommends an approval, for a PUD and site plan review it should go back to the Board for final approval. The proper procedures need to be reviewed and put into place.  It was suggested that the Township Attorney be at the November 17th Planning Commission Public hearing.  Griffes will contact her to see if she will be available.

There being no further business to come before the Board, Benjamin moved to adjourn at 7:27 p.m.  Support, Ream.  The motion passed.

Meeting called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Board members present:  Earl L. Griffes, Wilma J. Whitehead, Loretta K. Benjamin, R. Scott Diederich.  Absent:  Heidi Ream.  Also present:  Dennis Dyko, Shelly Hall, Robert McManaman, Ralph T., Steve Moreno, Monica Moreno, Larry Fulger, James Utz, Lindsay Utz.

After review, Benjamin moved to accept the minutes as presented.  Support, Diederich. The motion passed.

Mr. Fulger was present to provide updates, on his mobile home set up.  Rough electrical is completed, have wood stove option and the foundation, water and septic need to be finished before an occupancy permit is granted.

Griffes attended an Ingham County Parks & Recreation grant meeting.  The Township grant request is for additional accessibility to the playground from the pavilion and to connect the walking path over the park entrance drive. 

AGS was reviewed.  Griffes will contact them again for a cost list.

After review, Diederich moved to adopt the 2021-2022 final Budget, as presented.  Support, Benjamin.  Benjamin-Yes, Diederich-Yes, Griffes-Yes, Whitehead-Yes.  The motion passed.

Diederich gave a report on the September 9, 2021 N.I.E.S.A. meeting.  The Board approved the 2021 Tax Rate L-4029, 2021 American Rescue Fund Grant was approved and the Public Hearing for the General Fund Budget date was set for November 11, 2021.  The tornado siren was discussed and it is the responsibility of the Township, for all repairs.

September 7, 2021

Meeting called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Benjamin, R. Scott Diederich. Also present: Larry Fulger, Shelly Hall, Lindsay Utz, James
Utz, Steve Moreno.
After review, Benjamin moved to accept the minutes as presented. Support, Ream.
The motion passed.
Public Comment: Steve Moreno presented a hand out on the impact and harm on people,
property values and the environment that wind turbines could create. He stated that the
setback needs to be five miles, to not have any impact from sound and vibration. Mr. Moreno
feels our zoning for windmills needs to be rewritten, to address there setbacks, height and
sound impact. Shelly Hall commented that the Township Ordinance doesn’t say they will be
allowed, just with restrictions and that they aren’t wanted.
Larry Fulger reported that their well is in, but still needs wiring. Their septic tank is sitting in
their yard and looking for a digger. Working on foundation, plumbing and need electrical
inspection, before hanging drywall.
Heidi Ream stated that quotes are still needed for the sidewalk, from park pavilion to the
play ground, before the Ingham County Parks & Recreation meeting, on September 27 th .
The Clerk contacted Peterson Trees, about obtaining a quote to plant trees, in the Webberville
Cemetery addition.
Because of the unreliability, of the current internet service, the Board decided that a quote
from Verizon, for at least a bock up service, would be a good idea.
The Zoning Ordinance Amendments, Article 18, and the minutes from the Planning Commission
work session were reviewed. It was determined that the Planning Commission is required to
hold a Public Hearing on these amendments and make recommendations to the Township
Board, prior to adoption. Diederich moved to table zoning amendments. Support, Ream.
The motion passed.
The change to have a private company do the mechanical and electrical inspections for the
Township, was discussed. Complaints have been received about the time it takes the State
Inspectors to respond to inspection requests. Griffes will get additional information on AGS,
located in Schoolcraft, MI., for their cost and response time.

The 2020-2021 Audit was presented. Additional time to review was requested and will be
addressed for adoption, at the October meeting.
N.I.E.S.A. meeting report was given by Griffes. Plans are to replace the 2008 & 2013
ambulances with budget funds, for $749,950.92. Also, mentioned that the Webberville
Fire Station will be paid for next year.

Meeting called to order 7:00 p.m. by Supervisor, Earl L. Griffes.

Motion by Ream to accept the minutes as presented.  Support, Benjamin. Motion passed.

Larry Fulger stated that their little house that they have been residing in, has been sold. 

They are in the process of purchasing a septic tank and have their well and septic permit. 

Also, have plans to purchase an operable heating source.

The Ingham County Parks and Recreation grant was discussed.  Ream reported that a list

of plans, for the park were turned in and a detailed cost estimate needs to be submitted.

The Board decided that a monthly pest control contract, for the Library, will be reevaluated

if their bug problem persists.

Richard Chaffee has requested the release of a portion (2 acres) of Parcel #33-08-08-32-100-013 from the Farmland Development Rights Agreement (PA-116).  The parcel has a house and five sheds, on it.  After review, Diederich moved to allow the removal of said parcel.  Support, Ream.  Diederich-Yes, Ream-Yes, Griffes-Yes, Benjamin-Yes, Whitehead-Yes.  The motion passed 5-0.

The Fowlerville Senior Center request for funds to offset the 8% of their use, by Leroy Township residents.  Benjamin moved to support the Center with $300.00.  Support, Diederich.  Motion passed.

Meeting Minutes 7-13-21

Meeting called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

 

Board members present:  Earl L. Griffes, Wilma J. Whitehead, Heidi Ream, Loretta K. Benjamin, R. Scott Diederich.

Also present:  Dennis Dyko, Richard Estill, James Utz, Lindsay Utz, Shelly Hall.

 

The minutes of the regular June 1, 2021 meeting were presented.  After review, Benjamin moved to accept the minutes as presented.  Support, Ream.  The motion passed.

 

The Fulger property was discussed and their electrical permit has been pulled, no well work has been done and the current little home that they have been occupying, is listed for sale. Griffes read an anonymous letter stating their concerns about the condition, of the property. An option to contact the Ingham County Health Department for water and sewer violations was presented by an audience member.  Griffes will contact the Township Attorney to have a second letter sent to Mr. & Mrs. Fulger giving them until October 1, 2021, as the final date of occupancy.

 

Shelly Hall and R. Scott Diederich asked the Board’s approval for them to pursue the right to apply for three Liquor Licenses, at 3537 E. Grand River, Williamston.  The three licenses discussed were Class C, SDM and SDD Licenses.  After review, Whitehead moved to adopt Resolution #2021-03, stating that the request for the licenses be considered for approval and recommended for issuance, by the State of Michigan.  Support, Benjamin.  Ream-Yes,Benjamin-Yes, Griffes-Yes, Whitehead-Yes.  Diederich abstained.  The motion passed 4-0.

 

The Leroy Township Planning Commission made a recommendation to the Board, to accept the Zoning Ordinance Amendment, Section 606A, Off-Street Parking Space Design Standards. Dennis Dyko, Planning Commission Chairman, explained that generally not all properties will require a hard service lot if there is no public access and an exception where handicapped parking is needed.  Benjamin moved to accept Resolution #2021-04, to adopt Ordinance #33, Section 606A. which will take effect 7days after its adoption and after its publication.  Support, Ream.  Ream-Yes, Griffes-Yes, Benjamin-Yes, Diederich-Yes, Whitehead-Yes.  The motion passed 5-0.

 

The 2021 Local Road Agreement with the Ingham County Road Department was reviewed.  Motion by Diederich to accept the Agreement.  Support, Benjamin.  The motion passed.

 

Ingham County Parks & Recreation Department has applications available to apply for grant money.

 

A PA-116 Application was received from John and Tracey Knoch, to place 136 acres into the program.  After discussion, Benjamin moved to approve the application.  Support, Diederich. The motion passed 5-0.

 

The Webberville Branch Library submitted a request to purchase a baby changing table for the Library restroom and they are having problems with earwigs, in and around the Library. The Board moved to allow the table purchase and to contact Orkin, for pest treatment. 

The Michigan Township Association requested that the Board reaffirm the Principles of Governance, as an official policy, of the Township Board.  Motion by Whitehead to adopt the Principles of Governance that embody the core values of an efficient, effective, economical, ethical and accountable local government in Michigan.  Support, Benjamin.  Motion passed.

 

Scott Diederich reported that the N.I.E.S.A. Board, at the June 10, 2021, regular meeting that a base pay increase of $3.00 per hour creating a scaled pay structure with step increases based on experience, was discussed.  The department is receiving fewer job applications and a pay increase may help.  The 2020 Audited Financial Statements were accepted by the Board, with available funds decreasing yearly. 

 

Aaron and Lauren Knoch have requested the release of a portion (1.00 acre) of Parcel #33-08-08-36-300-001 from the Farmland Development Rights Agreement (PA-116).  After discussion, Benjamin moved to allow the removal of said parcel.  Support, Diederich. The motion passed 5-0.

Meeting Minutes 6-1-21

Meeting called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

Board members present:  Earl L. Griffes, Wilma J. Whitehead, Heidi Ream, Loretta K. Benjamin, R. Scott Diederich.

Also present:   Amanda Vorce, Larry Fulger, Dennis Dyko, Apex Clean Energy Representative, Shelly Schaub.

 The minutes of the May 4, 2021, regular meeting were presented.  After review, Benjamin moved to accept the minutes, with a correction of a first name, in paragraph four.  Support, Ream.  The motion passed.

 Larry Fulger was present and stated that he has obtained his electrical permit and an estimate to dig a new well and plans to have it started, as soon as their tiny house sells.  He is currently working on the home barriers.

 Amanda Vorce, new head librarian, of the CADL Webberville Branch, presented their 2020 annual report.  They have been working to provide hotspots for distance learning the Story Walk installation, in the Simmons Memorial Park, has been a big highlight and well received by area residents, with hopes to expand for a longer walk.

 The Board discussed the plans for Todd & Loretta Benjamin to apply to the Michigan Liquor Commission, for a license to sell beer and wine, at their farm.  The use might fall under the Right to Farm Act or under the Agritourism Farm Plan.  Griffes will check with the Township Attorney and Planner before a resolution is considered.

 

 N.I.E.S.A. report given by Earl Griffes, who attended the May 13th meeting.  The N.I.E.S.A. Board accepted the Standard Operating Guideline (SOG) for Rehab.  Also, discussed Website, Billing Ordinance, New Auditor, Federal Funding for State/Local Coronavirus Rescue Funds and Reinvestment of a six month CD.

 After review, Whitehead moved to pay all bills as presented and the remainder of the regular monthly bills that are received during the next week.  Support, Benjamin.  Diederich-Yes, Ream-Yes, Griffes-Yes, Benjamin-Yes, Whitehead-Yes.  The motion passed.

Also present:  Shelly Hall, Steve Geyer, Ryan Hitchcock, Caitlin Hitchcock, Brad Hitchcock, Sr., Brian Hitchcock, Allen Hitchcock, Lindsay Utz, James Utz, Nick Alexander, Larry Fulger, Jennifer Fulger, Steve Moreno, Monica Moreno.

 After review, Diederich moved to accept the minutes of the April 6, 2021 regular monthly meeting, as presented.  Support, Benjamin.  The motion passed.

 Mr. & Mrs. Fulger were present to updated the Board on their progress, to make their mobile home ready, to meet all the Township building requirements. They are in the process of getting a quote for drilling a new well and are doing electrical rewiring.  They are planning to be done by Fall.  Unable to eliminate any items, on the completed list of requirements, at this time.

 Rezoning of property owned by Steve Geyer, was reviewed.  Benjamin questioned that the proposed use of the property might require a Special Use Permit.  Ryan Hitchcock stated that they plan on outdoor sales and C-1 could fit better because nursery and landscaping are allowed.  James Utz stated that C-1 Zoning allows only indoor sales.  Motion by Diederich to accept the Planning Commission recommendation to approve the rezoning from RA (Residential Agricultural) to C-1 (Neighborhood Commercial).  Support, Ream.  Diederich-Yes, Ream-Yes, Griffes-Yes, Benjamin-Yes, Whitehead-Yes. The motion passed.  A site plan review is required.

 Michigan’s Uniform Video Service Local Franchise Agreement between WOW (WideOpenWest Mid-Michigan, LLC) and the Township, was reviewed.  Benjamin moved to accept the renewal, with the current 3% franchise fee.  Support, Ream.  Ream-Yes, Griffes-Yes, Benjamin-Yes, Whitehead-Yes, Diederich-Yes.  The motion passed.

 Diederich gave a report on the April 8, 2021 N.I.E.S.A. meeting.  A change in the have a fee schedule attached to the Billing Ordinance and Rehabilitation Guideline Policy, were discussed. Representative Slotkin’s meeting, with Director Yanz, concerning the SAFR Grant Funds update for emergency department equipment, was positive.

 The bills were presented and monthly invoices from Foster, Swift, Collins & Smith, P.C. included bills that were from another jurisdiction.  Griffes moved to pay all bills except for Foster, Swift and Collins & Smith, P.C.  Support, Benjamin.  Griffes-Yes, Benjamin-Yes, Diederich-Yes, Ream-Yes, Whitehead-Yes.  The motion passed.

Meeting was called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

 Board Members present:  Earl L. Griffes, Wilma J. Whitehead, Heidi Ream, Loretta K. Benjamin, R. Scott Diederich. 

Also present:  James Utz, Lindsay Utz, Shelly Hall, Brian O’Shea, Larry Fulger, Dennis Dyko,

Tim O’Brien, Steve Moreno, Monica Moreno.

 

After review, Benjamin moved to approve the minutes of the March 2, 2021 regular monthly Board meeting.  Support, Diederich.  The motion passed.

The minutes of the Annual Budget meeting, on March 24, 2021, were reviewed.  Motion by Benjamin to accept the minutes as presented.  Support, Ream.  The motion passed.

 Public comment:  Monica Moreno commented on the letter from Rosa Jones, presented at last month’s meeting.  Apex, Inc., should be providing information on the current status of their proposed wind turbine project, so as to be able to include the information for public record.  Brian O’Shea, Apex representative agreed that all information needs to be get out to the community and a public information meeting would be a good idea later.  They are still in the early process of obtaining land and conducting wind studies.  Shelly Hall asked who is going to make Apex accountable and that some residents are aware of the project and some are not.  Mr. O’Shea stated that it is difficult to do a project in a community that is against it from the beginning.  Monica Moreno questioned the possibility of a moratorium of the project or have monthly updates from the applicants available.  Tim O’Brien asked if the number of land owners, that they have spoken with and have accepted to lease their property, was available.  Mr. O’Shea responded that he will check for next month’s meeting.  Trustee, Benjamin asked if once the land owner signs on are the fully committed and stated that some property owners are being misled. 

 Larry Fulger was present to discuss the progress he is making on his mobile home.  Supervisor, Griffes reminded Mr. Fulger that a letter was sent, from the Township’s legal firm, more than 30 days ago, with no substantial progress to date.  Mr. Fulger said one half of the trailer is studded and installing insulation, cabinets and drywall, at this time.  His mother is not taking kindly to him cleaning up the property, even though he would like to.  Mr. Fulger stated that his occupancy date is sometime this fall and he was reminded that his unproductive proceedings is putting the Township in a poor position, while knowingly letting this go on and being aware of the situation.  Next month the Board wants a list of what needs to completed yet and to show more progress.  Another winter of living in the tiny home will not be tolerated and will have to go to court, if not new residence is not complete enough for occupancy.

 

The 2021-2022 Street Light Budget was presented by Treasurer, Ream.  After discussion, Benjamin moved to adopt the budget.  Support, Whitehead.  The motion passed.

 

Lawn Maintenance proposals were presented for review.  Lawn Crafters, Inc. provided three proposals, which included mowing the Township hall property and the park, and the landscaping for the hall.  Emjay Total Lawn Care proposals that were reviewed were for mowing the park, cemetery and the Township hall.  After discussion, Benjamin moved to accept the contract with Emjay for the mowing of the park, cemetery and hall properties, for 2021.  Support, Ream.  Benjamin-Yes, Diederich-Yes, Whitehead-No, Ream-Yes, Griffes-Yes.  The motion passed 4-1.  Motion by Benjamin to accept the bid from Lawn Crafters, Inc. for the landscaping for the Township Hall for the 2021 season.  Support, Diederich.  Ream-Yes, Griffes-Yes, Benjamin-Yes, Diederich-Yes, Whitehead-Yes.  The motion passed.

A letter from Nolan Law, LLC, which states that they have been retained by a group of citizens, from Wheatfield and Leroy Townships, who are concerned about the dangers of improperly sited industrial wind turbines, was reviewed.  The Board felt that Mr. Nolan contacting and communicating with the Township legal firm shouldn’t be paid for by the Township, until and when Apex, Inc. files a formal request for with the Township, to proceed with their proposed wind turbine project.

 

Benjamin moved to adjourn at 8:09 p.m.  Support, Ream.  The motion passed.

Meeting Minutes 3-2-21

March 2, 2021

Leroy Township Hall, 1685 N M-52Âļ Webberville, MI.

Meeting was called to order at 7:00 p.m. by Supervisor, Earl L. Griffes.

 Board Members present:  Earl L. Griffes, Wilma J. Whitehead, Heidi Ream, Loretta K. Benjamin.  Absent:  R. Scott Diederich.

Also present:  Dennis Dyko, James Utz, Sean Stocker, Nick Alexander, Steve Moreno, Monica Moreno.

 After review, Ream moved to accept the minutes of the February meeting as presented.

Support, Benjamin.  The motion passed.

 The Fulger property was discussed.  Supervisor, Griffes reported that there is no heat source in their mobile home and they have not moved in.  An occupancy permit is needed before they reside in the home.  A letter was mailed to them, from the Township Attorney and they hadn’t picked it up.  Griffes will deliver the letter to them.  The Board agreed to grant them an additional 30 days.

 A request for a Hardship Mobile Home Permit was reviewed, for Thomas H. Canfield, 1394 N. Dietz Road, Webberville.  Mr. Canfield has a medical condition, which requires him to have continuous care and his daughter will reside, in their original residence.  Their property is 2.5 acres parcel, without enough road frontage, to build another home on the property.  Motion by Benjamin to allow the Canfields to place a mobile home on their property, subject to all building requirements and permits and the hardship home must be removed when it is no longer needed, by Mr. Canfield.  Support, Ream.  Ream-Yes, Griffes-Yes, Benjamin-Yes, Whitehead-Yes.  The motion passed.

 A letter from resident, Rosa Jones, stating her opinion on the proposed Wind Turbine Project, was discussed.  A copy of the letter was made for everyone present.  James Utz commented, on the Township survey and how it will affect the project.  Apex representaives reply was that the survey is not an educated survey, which it lacks actual knowledge about the turbines.

 An email was received from a resident about the opening of the park during the winter months. 

The park is actually closed during the winter because of the liability and the need to plow the snow.   Motion by Benjamin to adjourn at 7:37 p.m.  Support, Ream.  The motion passed.
